The Federal Constitution of Brazil, also known as The Citizen Constitution, bring the ideal of equality between men and women. And highlights the needing of the material equality. The women, when incarcerated, are forgotten by the system, and their gender necessities are ignored, receiving the same treatment as male prisoners. The Penitentiary System believes in the consonant treatment to the prisoners, excluding their individualities, making that the desire for equality became closer to inequality and incapable to treat properly themes as menstruation and motherhood. This article has as main objective to analyze the Brazilian penitentiary system doing a gender cut, and inevitable, a race and class observation, trying to research the infraction of constitutional principle and the effectivity of the Criminal Procedure Law across bibliographic research and data analysis.
