the signs of capitalism and the feminist movement in Criminal Law

Abstract

The present work aims to analyze the inseparable link between State and Law in preserving the privileges of the bourgeois class and overcoming Capital crises, also adopting patriarchy as the main mechanism for the submission of bodies. Thus, the feminist movement, in the field of criminal sciences, by focusing on neocriminalization, the expansion of the criminal legal norm and the appropriation of symbolic Criminal Law, resembles the conservatism that finds the answer in the criminal justice system and in the criminalization of conduct. towards structural conflicts, distancing itself from the criticisms of Criminal Law and Capitalism. To this end, the deductive method was used, employing a bibliographical review based on thematic works related to the central theme. As a result, the indispensability of feminism, in its plurality of agendas and demands, was verified as an instrument for explaining the social ties constituted and reverberated in political, social and legal institutions. However, it is necessary to highlight that the disputes and debates for the occupation of minorities in these spaces are substantial to promote representation for vulnerable groups, facilitating resources and discussions silenced by the apparatuses that act in favor of capitalism, using them as temporary and strategic devices, considering the limits inherent to the entities and functionalities themselves and promoting revolution.
