Abstract

The article aims to analyze the normative frameworks that deal with the right to quality education and educational quality in Brazil. The study is based on bibliographical analysis and legal documents that deal with the topics. As results, we evidence that the term right to quality education is presented in a dissociated way in Brazilian legislation, whether as a right to education and as quality of education, as well as that there is a lack of analytical references to guide what would constitute the guarantee of the right to education. quality in Brazil.

Ricardo Hack é mestre em educação pela Universidade do Oeste de Santa Catarina (UNOESC). Pesquisador do grupo de pesquisas sobre Políticas públicas de avaliação educacional e accountability em países da América Latina. Possui graduação em Direito pela UNOESC (2010), pós-graduado em Direito Imobiliário, Notarial e Registral pela Universidade do Oeste de Santa Catarina (2016) e especialização em Direito Processual Civil (2018), ambos pela UNOESC. Atua como docente permanente no curso de Direito, da UNOESC.

Camila Regina Rostirola é doutora em Educação pela Universidade Federal do Paraná (UFPR). Atua como docente permanente no Programa de Pós-Graduação em Educação da UNOESC. Investigadora visitante do Instituto Interuniversitario de Investigación Educativa (IESED-Chile).
