Serious human rights violations and international crimes:
from the ius (non) puniendi of the Nation-State to a duty to punish as an imperative of ius cogens?

This article does not deal with the international responsibility of states for non-compliance with the imperatives, including jus cogens, of public international law, but with the content of this responsibility, through positive duties to investigate, prosecute and punish these crimes in the domestic criminal justice system and its link with criminal responsibility and punishability for violations of international crimes. The key question could be formulated as follows: What would be the duty puniendi of nation-states in relation to serious violations of human rights/international crimes derived from public international law and how would this duty be articulated with the ius puniendi of the nation-state and with the general principles of criminal law, especially the principle of legality? Does the duty puniendi oblige to convert the adagium nullum crimen, nulla poena sine lege into nullum crimen, nulla poena sine iure (customary international law - ius cogens)?
