Migração e Direito Penal na Espanha
Resumo
Partindo dos arts. 318bis e 89 do Código Penal espanhol, o artigo aborda, de forma crítica, a reação do sistema aos delitos praticados por estrangeiros, particularmente, o delito de favorecimento da imigração clandestina, bem como ao instituto da expulsão. O autor ressalta a intenção discriminatória que se encontra por trás das normas que regulam a situação, sobretudo, destaca o processo de exclusão social desencadeado pelo etiquetamento. Tendo em vista isso, e se baseando na teoria de Jakobs, o autor lança a tese de que tal situação seria caracterizável como típica hipótese de «Direito penal do inimigo».

Title: Migration and Criminal Law in Spain
Abstract: Starting from the articles 318bis and 89 of the Spanish Penal Code, the article discusses, in a critical way, the system reaction to the crimes committed by foreigners, particularly the crime of favoring of illegal immigration, as well as the institute of expulsion. The author highlights the discriminatory intent that lies behind the rules governing the situation, above all, it highlights the process of social exclusion triggered by labeling. In view of this, and based on Jakobs theory, the author throws the thesis that such a situation would be characterized as a typical case of "Criminal law of the enemy".
