The role of education: from natural right to the right to instruction

Abstract

The defense of the Public School System has always been related to the statement of the right to Education. But where are the philosophical basis of this right? In the ancient conservative conception of acquired rights that generated the Enlightenrnent proposition? Are they in the doctrine of natural right - where the Lumieres had ended up by sacrificing their autonomy's ideal to the emphasis of domination that will characterized the victory of the liberalism? Or, even further, in a singular concept of right that search its (previous) justification from the meaning presumed to be revealed by History? Even today, the notion "right" to Education is pierced by ali these ambiguities that the historical analysis scrutinized.
