O Regime Disciplinar Diferenciado e o Sistema Penitenciário Federal: A “reinvenção da prisão” através de políticas penitenciárias de exceção

O artigo coloca em análise dois projetos: o Regime Disciplinar Diferenciado (RDD) e o Sistema Penitenciário Federal do Brasil (SPF), tomando-os como dispositivos que emergem na adoção definitiva da lógica penal neoliberal configurada como a nova administração da pobreza. Compreende-se o RDD e o SPF como efeitos de uma mesma racionalidade penal: a medida e o aparelhamento de políticas penitenciárias de exceção que neutralizam e segregam determinados presos, fornecendo contornos atuais à noção de “alta periculosidade” e, assim, autorizando a adoção de medidas de recrudescimento disciplinar a partir de regimes de máximo confinamento e mínima concessão de direitos e garantias. Em nome da “defesa social” e da “disciplina carcerária”, o confinamento máximo do preso considerado de alta periculosidade instrumentaliza práticas de segregação e punição que, oficializadas por “legislações do pânico”, buscam justificação em princípios da criminologia positivista e se afirmam sobre o declínio do ideal ressocializador, espalhando, assim, uma ilusória sensação de que “a grande criminalidade” está sendo enfrentada de forma rígida e efetiva.
