Abstract

The present research analyzes working actions at law and the causes that motivate former-employed to require judicially against their former-employers. For this, was realized a multi-case, a kind of qualitative study, about the crowded processes in the Justice Court specifically in the Labor Relations of the Judicial district of the Sorriso City, Mato Grosso State, Brazil. For the theoretical basement it was necessary to know the scope of the Countable Skill, the norms that conduct the performance of the Countable Connoisseur and the prerogatives that guide the working laws as the Consolidation of the Working Laws (in Brazil, called CLT – Consolidação das Leis do Trabalho). It was evidenced that the factors that take the employee to set in motion judicially his employer in the labor law action are varied, being detached the lack of the working national register of the worker, lack of payment in days preset between the parts, lack of payment of the overtime and its consequences, nocturnal additional, and so on. It can conclude that the countable skill can be used as an instrument capable to inquire, to decipher and to raise true evidences to assist the magistrate to make correct decisions.
