Criminal Law and Ideology:
An analysis of the relationship between punitive power and the demands of the capitalist system

This article seeks to explore how ideology, as a guaranteeing mechanism for the reproduction of current social relations, influences the complex interaction between the punitive system and the demands of the capitalist system. The analysis starts from the delimitation of the concept of ideology, passing by a brief explanation about the emergence of modern Criminal Law, linked to the demands of developing capitalism and the conformation of the penalty according to the concept of equivalent retribution. Finally, it discusses the relationship between Criminal Law and globalized capitalism today, characterized by the swelling of the punitive system concomitant the suppression of welfare state, and by the belief in punitiveness as a response to deep social problems, through ideology, maintaining unequal social relations.
