Abstract

O presente artigo aborda o tema da hermenêutica da norma penal incriminadora por meio de uma visão interdisciplinar, que pretende aproveitar em relação à norma penal incriminadora as importantes contribuições formuladas pela mais avançada pesquisa realizada no âmbito da Filosofia do Direito. Salienta-se, contudo, a necessidade de, em tal tarefa, respeitar-se as peculiaridades decorrentes do princípio da legalidade em matéria penal.

Title: Hermeneutics of incriminating criminal law

Abstract: This article discusses the theme of hermeneutics of incriminating law through an interdisciplinary approach, which aims to take in relation to incriminating law the important contributions made according to the advanced research in Philosophy of Law. However, it is emphasized the need, in this task, to respected the peculiarities arising from the principle of legality in criminal matters.
