Política não-criminal e Processo Penal:
A intersecção a partir das Falsas Memórias da Testemunha e seu possível impacto carcerário
Abstract
A prova testemunhal é uma das mais utilizadas em âmbito processual. Por outro lado, as entrevistas à testemunha podem formar um quadro sugestionável, que pode redundar em falsas memórias. O artigo pretende discutir as vinculações desta situação processual penal com as políticas criminais contemporâneas. Para tanto, lançaremos mão de um referencial teórico crítico para pensarmos em formas efetivas de reduzir a possibilidade de falsas memórias. É necessário discutirmos o próprio catálogo de tipos penais disponíveis, talvez, a principal forma de afastarmos possíveis contaminações a redundarem em privações de liberdade.

Title: Non-Criminal Policy and Criminal Process: The intersection from false memories of eyewitness and their possible impact prison
Abstract: The testimonial evidence is one of the most used in procedural law. However, the interviews of the eyewitness may form a suggestible frame, which can result in false memories. This article discusses the relationship between this situation in the criminal process and the contemporary criminal policies. Therefore, we will take a critical theoretical reference to think about effective ways to reduce the possibility of false memories. It is necessary to discuss the own catalog of criminal types available, maybe this is the main way to eliminate the possible contamination, that it lead to arrests.
