Perguntas Sugestivas, Verdade e Contraditório
Resumo
Este artigo pretende estudar o fenômeno das perguntas sugestivas na oitiva de testemunhas no processo penal. Como fundamento legal, utiliza-se o Código de Processo Penal, principalmente seu art. 212, e a Constituição da República Federativa do Brasil. Com esse substrato, traçar-se-ão os fundamentos da vedação às perguntas sugestivas, sob uma perspectiva da admissibilidade probatória e dos valores reitores do processo penal brasileiro. Para tanto, faz-se necessário estabelecer que valores são esses, sob o que eles incidem, no aspecto específico do trabalho, e qual a consequência da violação à regra prevista no referido art. 212. Exposto isso, ver-se-á que a vedação à admissibilidade de perguntas sugestivas se justifica por um aspecto principiológico, tendo em vista que elas obstam o contraditório e por um aspecto teleológico, tendo em vista que elas obstam a busca da verdade. Com isso, chega-se à conclusão de que a consequência de se fazer uma pergunta sugestiva na oitiva de testemunhas no processo penal é a constatação de um vício e a decretação de sua nulidade.

Abstract: This article aims to study the phenomenon of leading questions on hearing of witnesses in criminal proceedings. As legal grounds, the Constitution of the Federative Republic of Brazil and the Brazilian Code of Criminal Procedure will be referred, particularly its article 212. Thus, the fundamentals of prohibition of leading questions will be outlined, from the perspective of evidentiary admissibility and the informative values of the criminal justice process. In order to fulfill this, it is necessary to establish which these values are, on what they focus, on the specific aspect of this work, as well as what are the consequences of violating the rule laid down in that article. After this, it will be seen that the prohibition to the admissibility of leading questions is justified by a matter of principle, considering that these questions hinder the adversarial principle, and by a teleological aspect, given that they hinder the pursuit of truth. With all of this being said, one comes to the conclusion that the consequence of making a suggestive question on hearing of witnesses in criminal proceedings can only be its nullity.
