¿Un romance que podría ser un delito de manipulación de precios de valores negociables (art. 309 CPA)?

Résumé

La idea de este trabajo es analizar desde el art. 309 del CP argentino y el analisis tecnico financiero la negociacion de compra de Twitter por parte de Elon Musk, y si esta novela de amor con la participacion de una tercera en discordia, incurriria  en el tipo penal de manipulacion de valores negociables. Para ello, se analiza las acciones del comprador, y como fluctuo el precio de los papeles de TWTR y TSLA en la bolsa de New York, posterior mente se vera el tipo penal del art. 309 CPA y se buscara una conclusion.

Twitter & Elon Musk a love story without a happy ending. A romance that could be a crime of manipulation of prices of negotiable securities (art. 309 CPA)?

Abstract

The idea of this paper is to analyse from the point of view of art. 309 of the Argentinean CP and the technical financial analysis the negotiation of the purchase of Twitter by Elon Musk, and if this love novel with the participation of a third party in discord, would fall under the criminal type of manipulation of negotiable securities. To do this, the actions of the buyer are analysed, and how the price of the TWTR and TSLA shares fluctuated on the New York Stock Exchange, and then the criminal offence of art. 309 CPA is examined and a conclusion is sought.
