THE PUBLIC MINISTRY AS EXECUTIVE POWER

The main theme of this paper is the Executive branch response to the demands of the Public Ministry accepted by the Judiciary branch. It is focused on the rendering of the most relevant public services, considered for that reason as social rights of citizens, such as health, education, judicial assistance and others. The core issue around which the theme develops is: does the Public Ministry invade the sphere of the Executive branch and, if so, why? Is there omission or lack of efficiency or effectiveness in the Executive branch’s actions? Writing an essay based on seven cases and big media news, the author seeks to justify his findings with the Federal Constitution of 1988 and in the way the nation became part of the globalized economy, following the Washington Consensus recommendations. However, if the initial issue is thus answered, others arise that remain unanswered and invite readers to reflection, such as: when faced with economic crises, would it not be possible for federated entities to share efforts and tasks today mostly concentrated on the Union’s Executive but, if successful, could benefit both member states and municipalities?
