Education enables the formation of conscious and critical citizens, capable of fully exercising their rights and duties, thus promoting full access to justice. The right to education is guaranteed by the Federal Constitution of 1988, however, there is an ongoing debate that seems unresolved - its true nature: is the right to education a personality right or an instrument for its realization? To deliberate within reason, this article is based on the hypothetical deductive method. The general objective is to analyze the right to education as an essential component of human dignity and the integral development of personality, as well as its instrumental role in promoting social justice and access to it; specifically, it seeks to address the right to education within the rights of the person, examine its function as a tool for social development, and discuss its relevance in the face of personality rights. This research highlights that this right appears as fundamental, being a means of access to other rights, concluding, therefore, that the guarantee and effectiveness of this right are focused on respecting and promoting human dignity, above all, the development of the individual’s personality.
