Abstract

The procedure for legally relinquishing a child for adoption may represent an exception to the order for the enforcement of the Right to Family Coexistence, since, by recognizing the right to maternal confidentiality, it prevents access to the parent and the extended family. Another problem arising from confidentiality is the violation of the right to origin, since the adoptive parent would only have access to maternal data. Thus, in order to verify whether maternal confidentiality violates the child's right to origin, this paper analyzed adoption as a way of enforcing the Right to family coexistence, examining the procedure for legal handing over for adoption and the right to origin as an aspect of the right to identity of children and adolescents. For this purpose, the deductive approach method was used.
