Abstract

In the context of Climate Injustice and Racism portrayed in the catastrophe that occurred in Rio Grande do Sul in the year 2024, in which a global scenario of ecological urgency was evidenced, adaptation measures gain importance. The research problem of this article consists of the question: how can adaptation measures deal with the scenario of Climate Injustice and Racism characteristic of the catastrophe in Rio Grande do Sul? The aim of the article is to investigate the ways in which adaptation measures can confront the scenario that occurred in Rio Grande do Sul. In the first subsection, the specific objective is to discuss the facts of the climate tragedy in Rio Grande do Sul and contextualize it within the global scenario of ecological urgency. The second subsection deals with the concepts and movements of Justice and Climate Racism and discusses the groups most impacted by the disaster. The third part of the article aims to conceptualize adaptation measures, explore Law 14.904/2024, as well as the possible relationships between implementing adaptation measures and tackling Climate Racism. The method of approach used in this research is deductive. Already the method of procedure adopted is the monographic, with extensive consultation in doctrine, national and foreign scientific articles. The research techniques used were bibliographic and documentary. The hypothesis of the article is corroborated, as the potential of adaptation measures to promote the resilience of the systems of communities most vulnerable to climate change has been asserted.

Pós-doutoranda pelo Programa de Pós-graduação em Direito da Universidade Federal de Santa Catarina – UFSC com projeto de título DIREITOS HUMANOS, EMERGÊNCIA CLIMÁTICA E SAÚDE: O QUADRO DE INJUSTIÇA SOCIOAMBIENTAL QUE PERPETUA DIFERENÇAS E O ENFRENTAMENTO DAS VIOLAÇÕES DE DIREITOS SOCIOAMBIENTAIS. PhD in Law - area of concentration Law, Politics and Society - from the Federal University of Santa Catarina - UFSC (2021), with a doctoral internship at the Rovira i Virgili University - URV - Tarragona, graduated in Law from UFSC (1991) and Master in Law - area of concentration Theory, Philosophy and History of Law, from the same University (2012). Researcher and teacher. She works in the areas of Environmental Law and Philosophy of Law with research on topics related to Ethics, Ecological Justice and Ecofeminism, with a Post-Doctorate in Law at the Federal University of Santa Catarina as a PDJ / CNPq fellow, and a research internship at the Autonomous University of Madrid - UAM (Speak4Nature Project).
