Criminologia, Direito Penal e História: possibilidades de entrecruzamentos à luz do controle social da vadiagem no início do século XX

Abstract

Title: Criminology, Criminal Law and History: possibilities of interlacement from the perspective of the Social Control of vagrancy at the beginning of the twentieth century

Resumo: A pesquisa busca abarcar as possibilidades de um entrecruzamento da criminologia com a história social, partindo da hipótese de que os processos de criminalização dos “vadios” no alvorecer da Primeira República no então Distrito Federal permitem observar uma maneira de trabalhar conjuntamente a criminologia e a história do direito penal, ajudando a superar uma visão limitada e legalista da história, limitada ao reproduzir de proibições e penas nos sucessivos diplomas repressivos, ao mesmo tempo em que se demonstra que o conhecimento do passado é, ao mesmo tempo, conhecimento do presente.

The starting point is the hypothesis that the processes of criminalization of vagrants in the First Republic of Brazil, in the Federal District, lets identify a way to work together the Criminology and the History of the Criminal Law. This helps to overcome a limited and legalistic view of the history, which is limited because it reproduces prohibitions and penalties in successive repressive codes, and, at the same time, it shows that the knowledge of the past is also of the present.
