Title: Efficiency vs. guarantees - The use of electronic monitoring system of prisoners (electronic anklet)
Resumo: O artigo trata da relação entre ciência e Direito Penal no contexto da sociedade de risco, decorrente da crise do sistema penitenciário brasileiro e das violações dos direitos e garantias dos encarcerados, bem como de algumas alternativas para solucionar emergencialmente o problema. Aborda a lei que instituiu o uso das tornozeleiras eletrônicas e a aplicação do princípio da eficiência no direito penal.

Abstract: The article analyze the relationship between science and criminal law in the context of the risk society, resulting from the Brazilian penitentiary system and violations of rights and guarantees of imprisoned crisis, as well as some alternatives to solve the problem on an emergency . It discusses the law that established the use of Electronic monitoring anklets with increased tracking capabilities and the principle of efficiency in the criminal law.
