Throughout human history, the concept of childhood and adolescence has undergone profound transformations, both social and historical, and has come to be recognized as essential stages of human development. In this process, children and adolescents have moved from a position of legal and social invisibility to being recognized as subjects of rights. As such, this article is the result of a descriptive study that aimed to outline the historical advances in the rights guaranteed to children and adolescents, as well as the historical milestone established by the promulgation of the 1988 Federal Constitution and the Statute of the Child and Adolescent (ECA). The methodology used consisted of bibliographical research, based on Brazilian legislation and studies on the subject. The findings indicate that, although there is a legal framework ensuring the protection of children and adolescents, significant challenges remain in the safeguarding and effective implementation of their rights in the country, where this group continues to be neglected and subjected to various forms of violence.
