Abstract

This article discusses the institution of Public International Law of refuge, however, from the perspective of Environmental Law, specifically from the perspective of the Disaster Rights theory, analyzing cases of human displacement caused by environmental disasters. The work discusses the intricacies of the institute of refuge in international law, subsequently relating it to environmental law and predicting the need to expand the concept of refuge. The article was carried out based on the deductive method, starting from a general premise and arriving at a specific cases, displacing thousands of people due to environmental disasters. The result achieved is due to the urgent need to broaden the concept of refugee, so that it includes the figure of the climate refugee or environmental refugee, firstly at the international level and, subsequently, in the internal rights of the various States.
