A AUSÊNCIA DE CORRELAÇÃO NECESSÁRIA ENTRE O ATIVISMO JUDICIAL E O CONSTITUCIONALISMO ABUSIVO

This article analyzes the concepts of judicial activism and abusive constitutionalism, seeking to demonstrate the lack of necessary correlation between them based on an institutional conception of the operating model of constitutional jurisdiction. To this end, the text starts from understanding the phenomenon of judicial activism, presenting its conditions of possibility in the Brazilian reality and then analyzes the elements of characterization of unconstitutional abuse, in order to demonstrate the lack of necessary connection between both concepts . In short, based on the hypothetical-deductive research method and qualitative, bibliographic and documentary study techniques, the work is based on the study of the practical and proactive application of the Constitution by the Judiciary, without this necessarily representing an unconstitutional abuse resulting from the interpretation process.
