In this article, through a document analysis of the resolutions and the general regulations that convened CONAE 2024, we examine whether the legislation contributed to its participatory planning, providing a historical and conjunctural contextualization based on Avritzer (2008) and Dourado (2009; 2019). We found that legal design guarantees representative and deliberative capacity, influencing the agenda and the design of a State policy, which was subsequently reinforced by the enactment of Supplementary Law No. 220/2025, ensuring its institutional nature, regardless of the will power of government officials.
