The present article aims to analyze the construction of the health legal system found in the brazilian Federal Constitution of 1988, as well as the constitutional changes occurred after its enactment. Therefore it will be traced a historical of the health legal system in Brazil from its Independence in 1822 to its redemocratization after the Military Dictatorship and the constitutional amendments suffered by the Citizen Constitution. The methodology adopted was the systematic review. It was concluded that, despite the undeniable advances in the right to health in Brazil, the financing of the Unified Health System remains neglected, which compromises the provision of public health actions.Downloads
