A separação judicial e o novo Código de Processo Civil

Resumo

RESUMO

Desde a entrada em vigor da Emenda Constitucional nº 66 de 13 de junho de 2010, subsiste a discussão, permeada de polêmica, acerca da modificação ocorrida no § 6º do artigo 226 da Constituição Federal de 1988, que deixou de condicionar o divórcio à prévia separação judicial ou de fato. Tal alteração permitiu que os cônjuges se divorciassem automaticamente, sem qualquer óbice. Em 2015, com o advento do novo Código de Processo Civil, reacendeu-se tal discussão, pois este teve, a princípio, o condão de sanar a dúvida do que fora objeto de reflexão durante muito tempo. O novo diploma legal parece ter abraçado a corrente que entende tão só pela supressão do requisito temporal obrigatório, entendendo pelo não fim da separação judicial pela EC66/2010. Nesse sentido, haja vista a insegurança jurídica que ainda permeia esse campo, o presente artigo proporá reflexão acerca não só dos diferentes pontos de vista, mas também das consequências que advirão dessa “novidade” trazida pela legislação processual infraconstitucional.

ABSTRACT

Since the entry into force of Constitutional Amendment no. 66 of June 13, 2010, there existed a discussion about the modification occurred in the article 226, paragraph 6º of the Constituição Federal of 1988, that ceased to condition the divorce to the previous separation judicial or de facto. Such change allowed the married to divorce automatically, without any obstacle. In 2015, with the advent of the new Code of Civil Procedure, this discussion was restarted, since it had, at first, the solution to the question of that had been the object of reflection for a long time. The new legal act seems to have embraced the current that suppressed only the compulsory time requirement, not the end of judicial separation by EC66/2010. In this sense, given the legal uncertainty that still permeates this field, this paper will propose a reflection not only on the different points of understanding, but also on the consequences that will come from this "newness" brought by the infra-constitutional procedural legislation.
