Abstract

O artigo analisa a afirmação do direito ao ensino médio na legislação brasileira, desde o período imperial à atualidade, relacionando-a a contextos sociopolíticos e educacionais. Até a elaboração da Constituição de 1988, a legislação nacional omitiu a afirmação desse direito ou ofereceu débeis garantias para tal afirmação, delimitando sua elitização. A configuração vigente do ordenamento jurídico é examinada sob a ótica da complementaridade entre a obrigatoriedade escolar e a determinação de universalização do acesso ao ensino médio.
