Considerações sobre a Alteração da Redação do Artigo 6º da CLT Impostas pela Lei 12.551/2011

Resumo: O presente trabalho analisa a alteração da redação do artigo 6º da CLT dada pela Lei nº 12.551/2011 a fim de verificar eventuais mudanças em decorrência desta alteração. Para tanto, analisa a redação anterior buscando entender o seu verdadeiro alcance, verificando-se que o dispositivo equiparava o trabalho a domicílio ao desempenhado no interior do estabelecimento de trabalho quando já caracterizada a relação de emprego Em seguida assinala as principais alterações impostas pela Lei 12.551/2011, apontando os aspectos mais relevantes que foram alterados. Identifica que a nova redação do artigo 6º da CLT possui com principal finalidade, além de equiparar o trabalho realizado à distância ao realizado no interior da unidade de trabalho, igualar o meio de controle indireto por meios telemáticos e informatizados ao controle direto e pessoal do empregador sobre o empregado, concluindo, por fim, que muito provavelmente a alteração realizada não acarretará em mudanças significativas no Direito do Trabalho.

Abstract: The present paper analyzes the changes in the article 6 of CLT caused by the Law n. 12.551/2011 and it aims at verifying eventual changes due to this alteration. For achieving this purpose, it analyses the former article aiming to understand its real scope and verifies whether the article equated home office activities to the ones taken in a regular office when it is already established the labor relation. Following that, it shows the main changes imposed by the Law n. 12.551/2011, focusing on the most relevant aspects changed. It shows that the main purpose of the new text of article 6 from CLT is, other than equating the home office activities to the ones taken in a regular office, matching online and technological means of control to the direct and personal control that employers make over employees. It can be concluded that the alteration might not bring substantial changes to the Labor Law.
