A Rethorical Understanding of the Legal Gap

Beyond the Normative Void and the Logical Completeness of the Legal System

Abstract

The main purpose of this paper is to propose a rhetorical understanding of what Law Theory conventionally calls a gap. To this end, it makes use of the dissoì lógoi methodology. For this reason, it initially analyzes the gap as a normative void, as the School of Exegesis would have it. Later on, it examines the concept as a logical impossibility, as argued by Hans Kelsen. And, in a third moment, it sustains, as a result of the research, that this notion is an opportunity for the construction of the legal norm. After that, the conclusion is presented.
