A Hermeneutic-linguistic Critique of Robert Alexy's Concept of Legal Interpretation

The purpose of this study is to criticize Robert Alexy’s concept of legal inerpretation grounded in a few assumptions of philosophical hermeneutics, philosophy of language and contemporary legal linguistics. After delineate the fundamental aspects of this concept of interpretation, inconsistencies founded in it will emerge, along with, several theoretical repercussions of these contradictions in the thinking model developed by the author and, ultimately, certain practical consequences of these findings. Regarding the last point, the focus will be on the indefensibility of Alexy’s concept of norm, specially his concept of legal rule and the possible consequences of the application of this concepts by the judiciary.
