Abstract

Canon Law sources from the 12th and 13th centuries indicate that the control and payment of tithes performed a series of religious, political, and social functions. Among these functions, we can highlight the political, spatial, and jurisdictional organization of parishes, dioceses, and of the papacy itself. In a slow process in which the concept of jurisdiction was also under construction, tithes played an essential role in the definition and delimitation of ecclesiastical jurisdictions, particularly regarding episcopal and papal jurisdictions. Analyzing Hostiensis’s the Summa Aurea (1253) through an intertextual comparison against work as the Liber Extra and Gratian’s Decretum, this paper’s goal is to demonstrate the relationship between the discourse on tithes and the definition both of the concept and of the practical action of ecclesiastical jurisdiction between the 12th and 13th centuries.
