Resumo

O artigo argumenta que o positivismo jurídico de H. L. A. Hart é vulnerável à crítica de dar sustentação a regimes autoritários ou totalitários. Para isso, se reconstrói o argumento de Hart em seu artigo “Positivism and the Separation of Law and Morals”, mostrando que, nele, Hart nega uma conexão necessária entre direito e moral e, ao mesmo tempo, afirma uma conexão necessária entre direito e autoridade. Com isso, seu positivismo jurídico assume características do positivismo ideológico, ao implicar que pessoas sujeitas ao poder de um soberano de facto precisam compreender o direito daquele soberano como dotado de autoridade, qualquer que seja o seu conteúdo. Esse resultado, rejeitado por Hart, emerge especialmente de suas respostas a Fuller e Radbruch. Conclui-se com uma exortação à retomada do projeto teórico de Radbruch e outros autores, que consiste em compreender o direito como uma ordem jurídica que pode fazer jus à sua pretensão de autoridade legítima, o que exige abandonar a tese da separação entre direito e moral.
