UMA ANÁLISE DE NORMATIVOS ESTADUAIS A PARTIR DO DECRETO Nº 26/1991

Abstract

This paper examines how indigenous school education is implemented in the states of the Southeast Region of Brazil (Espírito Santo, Minas Gerais, Rio de Janeiro, and São Paulo). With Decree No. 26/1991, responsibility for indigenous school education was transferred from currently the National Indigenous Peoples Foundation (Funai) to the Ministry of Education, being shared among the Brazilian federal government, states, and municipalities. Through documentary research, we investigated how these states, which are the most industrialized and urbanized in the country, address indigenous school education in their laws and regulations. We analyzed laws, decrees, resolutions, and guidelines of the four states, focusing on three fundamental rights of indigenous peoples: the right to education, the right to the use of indigenous languages in education, and the right to participate in decisions about education. Our objective was to identify the advances and challenges that indigenous peoples face in the Southeast Region to ensure their right to education.
