Abstract

This paper seeks to question the legitimacy of the so-called temporal framework thesis as a legal device in our country by presenting, as an argumentative contrast, a synthesis of the historical contacts of the indigenous Laklãnõ people with the surrounding society that invaded and exploited their territories, abducted their children, murdered their elders, raped their women, and has been attempting for two hundred and fifty years to erase their language, culture, memory, and identity, while persistently making efforts to impose conditions of economic and social dependence within a legal system that is alien to them. Currently, this reaches its peak as it attempts to use the judiciary to further restrict the already precarious and limited access of these indigenous peoples to their traditional territories, with foreseeable similar impacts for over eight hundred indigenous lands throughout the country.
