INDIGENOUS TERRITORIES AND THE MARCO TEMPORAL THESIS: ORIGINAL RIGHTS UNDER THREAT

Over the years, indigenous peoples have suffered different forms of violations, making the naturalization and silencing of indigenous genocide in Brazil evident. Faced with this context, the aim of this article is to present theoretical reflections, based on the analytical category "Indigenous Territories", centering the discussion on the unconstitutionality of the Marco Temporal Thesis. Among the main reflections, the research highlights that the possible approval of the Marco Temporal Thesis by the Federal Supreme Court (STF) would jeopardize fundamental issues that fall within the territorial, environmental, cultural and humanitarian dimensions. These issues have devastating impacts on the environment and the constitutional rights of indigenous peoples in the country, making them even more vulnerable to the genocidal and ecocidal capitalist agenda.
