Beccaria y los límites al derecho de castigar
Resumo
La presente ponencia se ocupa de la forma como Cesare Bonesana, Marqués de Beccaria, delineó los límites al ejercicio de la potestad punitiva del Estado sobre todo a partir de las reflexiones consignadas en el segundo capítulo del libro ‘De los Delitos y de las Penas’ intitulado como ‘Derecho de castigar’. Con tales miras, en primer lugar, se muestra la forma como se abordan en la obra los fundamentos al ejercicio de la potestad punitiva; en segundo lugar, se exponen los principales postulados acogidos por el gran pensador, los mismos que hoy conforman lo que se ha dado en llamar un ‘derecho penal mínimo’; y, por último, se alude a la situación actual del Derecho Penal, a partir de lo cual se examina el impacto de las ideas de Beccaria.

Title: Beccaria and the limits to the right of punish
Abstract: The present paper deals with how Cesare Bonesana, Marchese of Beccaria, has delineated the limits to the exercise of the punitive power of the State, especially as from the reflections recorded in the Second Chapter of the Book “Of Crimes and Punishments”, entitled as “Of the right to punish”. With such a view, first, it is displayed how has been addressed in this work the fundaments to the exercise of the punitive power; second, it is exposed the main principles embraced by the great thinker, which today make up what has been called “minimum criminal Law”; and finally, is referred to the current situation of the criminal Law, from which is examined the impact of the ideas of Beccaria.
