THE IMPOSSIBILITY OF ‘LEGAL TRANSPLANTS’

RESUMO: Há muitos anos, uma grande quantidade dos estudos de direito comparado tem sido baseada na metáfora dos “transplantes jurídicos”. Este artigo argumenta que a expressão “transplantes jurídicos” é enganosa, na medida em que transmite uma visão inadequada da maneira pela qual as leis deslocam-se através das fronteiras. Com efeito, este artigo afirma que, de fato, não acontecem “transplantes”. Embora essa crítica não pretenda sugerir que as ideias ou formas de palavras não consigam migrar, enfatiza que elas não são “transplantadas”, que não se deslocam e criam raízes em seu novo ambiente sem ser modificadas de alguma forma. Pelo contrário, sempre que uma ideia ou forma de palavras se desloca, sua configuração no ponto de chegada é obrigada a diferir da que existia no momento da partida, mesmo que apenas por conta da aculturação necessária que deve ocorrer no novo ambiente – apesar da impressão falaciosa sugerida pelo termo “transplante”.

ABSTRACT: For many years, much of comparative legal studies has been informed by the metaphor of “legal transplants”. This Article argues that the expression “legal transplants” is misleading in as much as it conveys an inadequate view of the way in which laws travel across borders. Indeed, this Article claims that there are in fact no “transplants” happening. While this critique does not wish to suggest that ideas or forms of words fail to migrate, it emphasizes that they are not “transplanted”, that they do not travel and take root in their new environment without having been modified in any way. On the contrary, whenever an idea or form of words travels, its configuration at the point of arrival is bound to differ from that which existed upon departure, if only on account of the necessary acculturation that must take place in the new environment — despite the fallacious impression being suggested by the term “transplant”.

Pierre Legrand, Ecole de droit de la Sorbonne, Paris

A graduate of the University of Oxford and the Sorbonne, Professor Dr. Dr. Pierre Legrand teaches law at the Sorbonne where he acts as director of the postgraduate programme in comparative legal studies. He also teaches as Visiting Professor at the University of San Diego Law School and as Se nior Fellow at the University of Melbourne Law School. In addition, he teaches every year in Romania and China.
