A abordagem retórico-analítica pressupõe três diferentes níveis de retoricidade da linguagem: o material, o prático e o analítico. Procuro estruturar a própria ideia de direito a partir deste ponto de vista retórico afim de esboçar uma teoria retórica do direito. Desse modo seria possível estabelecer três níveis para a retórica do direito: o nível mais básico da retórica material do próprio vocabulário empregado na confecção de textos normativos; o nível intermediário da retórica da dogmática jurídica; e, por fim, o nível mais elevado, do ponto de vista reflexivo da argumentação, da retórica analítica da teoria e da filosofia do direito. Se essa hipótese se confirma, será possível afirmar que o direito é um fenômeno essencialmente retórico, isto é, argumentativo e dependente dos discursos jurídicos em seus três diferentes níveis de retoricidade.</p><p> </p><p><strong>PALAVRAS-CHAVE:</strong> Retórica Analítica. Teoria do Direito.</p><p> </p><p><strong><em>ABSTRACT: </em></strong><em>This paper aims to discuss the possibilities of applying the analytical rhetorical scheme to the theoretical study of law in its different levels of discursivity and reflexivity. The analytical rhetorical approach presupposes three different levels of language’s rethoricity: the material one, the practical one and the analytical one. I try to structure the very idea of law from this analytical rhetorical point of view in order to outline a rhetorical theory of law. In this way, it would be possible to establish three levels for the rhetoric of law: the most basic level of material rhetoric of the very vocabulary employed in the making of normative texts; the intermediate level of the rhetoric of legal dogmatics; and, lastly, the highest level, from the point of view of argumentation, of the analytical rhetoric of both legal theory and legal philosophy. If this hypothesis is confirmed, it will be possible to sustain that law is an essentially rhetorical phenomenon, that is, argumentative and dependent on legal discourses in its three different levels of rhetoric.</em></p><p><em> </em></p><p><strong><em>KEYWORDS:</em></strong><em> Analytical Rhetoric.
