Essa objeção será discutida em duas partes na presente exposição. Num primeiro momento se discutirá se os princípios constitucionais garantem às partes um direito de recorrer de uma sentença de um tribunal estatal ou de uma corte arbitral. Num segundo momento, serão descritos os esforços atuais no sentido criar-se tribunais de investimento de segunda instância no âmbito dos acordos de livre comércio.</p><p> </p><p><strong>PALAVRAS-CHAVE:</strong> Direito de apelação. Tribunal Permanente de Investimento.</p><p> </p><p><strong><em>ABSTRACT:</em></strong><em> In Germany, the Investor-State arbitration has been criticized because, as regulated in the latest free trade agreements, it has failed in the sense that there is no possibility of appealing the sentence issued by the arbitral tribunal. This objection will be discussed in two parts in the present presentation. At first, it will be discussed whether constitutional principles guarantee the parties a right to appeal against a sentence of a state court or an arbitral tribunal. Secondly, the current efforts to create second instance investment courts under free trade agreements will be described.</em></p><p><em> </em></p><p><strong><em>KEYWORDS: </em></strong><em>R</em><em>ight of appeal.
